When is a building permit required?

A Building Permit is needed for:

  • Any construction or alteration of a structure
  • The demolition of a building or structure (a material hazard evaluation may be required)
  • Installation of any type of swimming pool
  • A change in use or occupancy of a building or structure
  • Any property or building requiring a Design Review from the Planning Board (see Article 11 of the Ogunquit Zoning Ordinance)
  • Fireplace and chimney construction or modification
  • Piers, wharves and docks
  • A one for one replacement of decks, porches, stairs and guard rails
  • Wireless Communication facilities and towers (see Article 9.16 of the Ogunquit Zoning Ordinance)

Additional Documents

With the building permit application, some other documents may be needed for permit approval (depending on the project):

  • Site Plan - this plan must show the setback distances from all property lines, wetlands, water bodies, septic tanks and fields, wells and buildings of separate ownership on a common lot; to the proposed new or addition to a structure
  • Proof of Ownership - a deed, or other legal standing for authorization to do the work
  • Authorization from your condo association
  • Authorization from the water and sewer district or a Subsurface Wastewater Design by a Maine Licensed Site Evaluator
  • Building plans to include applicable foundation plans, floor plans, applicable structural cross sections and front, side and rear elevations

Other Permits That May Be Required with a Building Permit

  • A Barrier Free Permit from the State Fire Marshals Office (applications are available from the CEO's office)
  • A Construction Permit from the State Fire Marshals Office (applications are available from the CEO's office)
  • An NF.P.A. 96 Determination (applications are available from the CEO's office)
  • Road Opening Permit
  • A Septic System Variance
  • A Shore Land Zoning Permit
  • D.E.P. Permit by Rule (applications are available from the CEO's office)
  • D.E.P. Maine Construction Permit (applications are available from the CEO's office)
  • All Signs require a Sign Permit except Exemptions noted in Article 8.12.2 Signs of the Ogunquit Zoning Ordinance
  • All fences require a Fence Permit (See Article 8.6 Fences of the Ogunquit Zoning Ordinance)
  • All yard sales require a Yard Sale Permit (See Municipal Ordinance Chapter 6)
  • A Subsurface Wastewater System (HEE-200 State Permit) must be designed by a Maine Licensed Site Evaluator; the Permit must be approved and issued by the Local Plumbing Inspector; ("the LPI"). A copy of this approved permit is then sent to the Maine Department of Human Services for review and recording
  • Internal Plumbing Permits must be obtained when you move or add any water or drain pipe, add a water heater, a new plumbing fixture or bathroom that is moved or added, etc. A permit is not needed when you replace a fixture, re-set a toilet or other normal maintenance and repair
  • All Internal Plumbing Permits must be on a State HHE-211 permit application and filled out by the Master Plumber doing the work. The Local Plumbing Inspector approves the permit and submits a copy to the Maine Department of Human Service
  • Home Occupation Permits are required as outlined in Article 9.7 of the Ogunquit Zoning Ordinance
  • Blasting Permits are required as outlined in Article 13 of the Ogunquit Zoning Ordinance
  • Heating Appliance Permits are required when installing or replacing an appliance which incorporates Number 2 fuel Oil, liquid petroleum gas, kerosene or other flammable fuel used to create heat
  • One and Two Family Electrical Permits for all new electrical work and any upgrading or a change in service, sub-panels and grounding. All work shall be in accordance with NF.P.A. - NEC 70, 2000 edition or later
